Terms of Service

These Terms govern access to tubistech.com, Tubis Technology Inc.’s connectivity hardware, and the Click Intelligence digital measurement service. “Tubis Technology,” “we,” “us,” and “our” mean Tubis Technology Inc. A signed quote, order, or service agreement may add terms and controls; if it conflicts with these Terms, the signed document controls for that purchase or service.

Business customers only

Our products and services are available only to lawfully operating businesses and organizations, acting through representatives authorized to bind them. They are not offered for personal, consumer, or household use. By requesting, buying, or using a product, you represent that your business is legally formed or registered where required, that you have authority to act for it, and that the information you provide is accurate. We may request reasonable business and identity verification or decline, suspend, or terminate access if eligibility cannot be confirmed.

Permitted use

You may use hardware and Click Intelligence only for legitimate, lawful business purposes and in accordance with applicable law, your customer agreements, and the rules of advertising, analytics, and other platforms you use. Access to the Work With Us form is an inquiry only; it does not create an account, order, license, or service relationship. Service access begins only after we accept the business and execute any required order or agreement.

Strictly prohibited activity

Any illegal activity or use that facilitates illegal activity is strictly prohibited. You may not use, buy, configure, or permit another person to use our products or services to:

Security testing is permitted only with our prior written authorization and within its stated scope. We may investigate suspected violations, preserve relevant records, restrict traffic, suspend access, or terminate service when reasonably necessary to protect users, customers, platforms, or legal rights.

Click measurement and destination transparency

For every Click Intelligence endpoint that we make available for advertising click measurement, the next hop must be declared in a visible URL query parameter identified in our setup documentation. The service must follow that declared destination as the immediate next hop, after server-side validation; a hidden backend destination may not override it. This behavior must work on every published tracking path. Redirects must use HTTPS and be server-side, and may not pass through an undisclosed tracking domain; any internal intermediate domain must be owned and operated by Tubis Technology and must not change the declared destination. We will document service-specific parameters and supported paths, and will not add arbitrary customer-supplied parameters that can change the destination. Customers must preserve the destination and any third-party parameters within the declared destination URL, may not use cloaking or conditional redirects, and may not nest another tracker unless the destination platform permits it and every tracker in the chain is approved for that use. The final destination in the ad and the declared redirect destination must match. Customers may use a tracking endpoint in a platform’s tracking-template field only after confirming that the service, domain, path, parameters, and full redirect chain meet that platform’s current approval requirements. These terms do not state that a particular endpoint has been approved or that the service is currently available.

Hardware orders and service access

Hardware specifications, pricing, delivery, warranties, and support are stated in the applicable written quote or purchase agreement. Click Intelligence features, service levels, fees, and data-retention settings are stated in the applicable service order. Unless a signed agreement grants broader rights, we grant the customer a limited, non-exclusive, non-transferable right to use the service for its own lawful business during the service term. You may not resell, sublicense, or provide access to others without our written permission.

Customer responsibilities and data

You are responsible for your websites, destinations, notices, consents, data sources, account credentials, user access, and decisions made using reports. You must have the rights and legal basis needed to provide information to us and instruct us to process it, give affected people the required notice, and promptly notify us of unauthorized access or suspected misuse. You may not use a bot or fraud indicator as the sole basis for a decision that produces legal or similarly significant effects about a person; arrange meaningful human review and provide the rights required by law. Our Privacy Policy describes information handling.

Data processing terms

Where Click Intelligence processes personal data on a customer’s behalf, the parties will enter a binding data-processing addendum or include equivalent processor terms in the service order when required by applicable privacy law or agreed in writing. Those written terms will specify the processing subject matter and duration, nature and purposes, data types and data-subject categories, and the parties’ rights and obligations. They will also address documented instructions, confidentiality, appropriate security, authorized subprocessors and change notices, assistance with individual requests and security or regulatory duties, return or deletion, audits, and any required transfer safeguards. Click and conversion data may include online identifiers, IP addresses, click and campaign identifiers, timestamps, browser/device and referrer data, destination URLs, and conversion events. The customer must provide documented instructions and ensure it has the rights and legal basis to provide the data. The applicable service order will identify the data and processing details needed to operate the service. No personal data may be submitted for processing before any processor terms required by applicable law or the parties’ agreement are in effect.

Intellectual property

Tubis Technology and its licensors retain all rights in our websites, software, documentation, designs, and technology. You retain rights to materials you provide and grant us only the limited rights needed to provide the ordered products and services. Feedback may be used to improve our offerings without restriction, provided it does not disclose your confidential information.

Availability, suspension, and termination

We may update or maintain the website or service and may suspend access for security, legal, payment, or policy reasons. Either party may end a service according to its signed agreement or order. On termination, access ends and customer data is handled under the applicable agreement and Privacy Policy. Provisions that by their nature should continue, including restrictions, intellectual property, payment obligations, disclaimers, and liability provisions, survive termination.

Disclaimers

Except for warranties expressly stated in a signed order or agreement, the website and services are provided “as is” and “as available” to the fullest extent permitted by law. Click and conversion measurements are estimates based on available signals; bot or fraud detection can produce false positives or miss activity. Reports are decision-support information, not a guarantee of results, traffic validity, ad-platform acceptance, or fraud prevention. You remain responsible for reviewing activity and complying with applicable laws and platform policies.

Limitation of liability

To the fullest extent permitted by law, Tubis Technology will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from these Terms or the products and services. Nothing in these Terms limits liability that cannot lawfully be limited. A signed order or agreement may specify any applicable liability cap.

Changes and contact

We may update these Terms by posting a revised version and date. Continued use after the effective date means acceptance of the revised Terms where permitted by law. Contact inquiry@tubistech.com or write to Tubis Technology Inc., 150 South Los Robles Ave., Suite 830, Pasadena, CA 91101.
